Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of Foyro, an AI-powered photo retouching service operated by Andrii Tsyhanok from Romania. By accessing or using Foyro, you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old to use Foyro. By using the service, you represent that you meet this requirement. Accounts are personal and non-transferable.

3. Service Description

Foyro provides AI-based photo retouching tools, including skin retouching and horizon correction. You upload photos, select processing options, and receive retouched images. Service availability and processing speed may vary based on demand and system load.

4. Token System

• Foyro operates on a token-based system. Each photo processed consumes one token.
• Tokens are digital credits with no cash value and cannot be redeemed, transferred, or exchanged for fiat currency.
• Unused tokens do not expire as long as your account is active.
• Token balances are tied to your account and cannot be transferred between accounts.

5. Payments

• All payments are processed by Whop, which acts as the Merchant of Recordfor all transactions. Whop's name will appear on your payment statement.
• Whop handles payment processing, tax collection (including EU VAT), and first-line dispute resolution on our behalf.
• Prices are displayed in USD and include applicable taxes where required by law.
• We reserve the right to change pricing at any time. Price changes do not affect tokens already purchased.

6. Refunds & Right of Withdrawal

6.1 General Policy

All purchases of tokens involve digital content and are considered non-refundable and non-exchangeable once the tokens have been delivered to your account. Tokens are delivered immediately upon successful payment.

6.2 EU Consumer Right of Withdrawal

If you are a resident of the European Union, you have a statutory right to withdraw from a digital content purchase within fourteen (14) calendar days without giving any reason.

However, under Article 16(m) of the EU Consumer Rights Directive, this right does not apply to the supply of digital content if performance has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal.

BY COMPLETING YOUR PURCHASE, YOU EXPRESSLY CONSENT TO THE IMMEDIATE PERFORMANCE OF THE SERVICE AND ACKNOWLEDGE THAT YOU WAIVE YOUR RIGHT OF WITHDRAWAL ONCE THE TOKENS ARE CREDITED TO YOUR ACCOUNT.

Accordingly, all token purchases are final and non-refundable, except where required by mandatory applicable law or in the case of a persistent technical defect on our platform that prevents you from using the purchased tokens.

6.3 Exceptional Refunds

If you experience a persistent technical defect that is solely attributable to our platform (not user-side factors such as device compatibility, connectivity, or browser issues), and you have not used any of the purchased tokens, you may request a discretionary refund within 14 days of purchase by contacting [email protected]. Refund decisions are made on a case-by-case basis.

7. User Content

You are solely responsible for all photos and content you upload to Foyro. By uploading, you represent and warrant that:

• You own or have all necessary rights to use and process the content.
• Your uploads do not violate any applicable law or regulation.
• Your uploads do not infringe any third-party intellectual property, privacy, or publicity rights.
• Your uploads do not contain illegal, harmful, threatening, defamatory, obscene, or hateful material.

We do not review, monitor, or moderate uploaded photos. We act solely as a processing tool. We do not view your images unless required by law or to investigate a reported violation. You grant us a limited license to process your photos solely for the purpose of providing the retouching service.

We reserve the right to delete any content and terminate any account without notice if we become aware of violations. We cooperate fully with law enforcement and will report suspected illegal content to the appropriate authorities.

8. Acceptable Use

You agree not to use Foyro for any unlawful purpose or in any way that:

• Violates any applicable local, national, or international law.
• Uploads content that is illegal, harmful, threatening, defamatory, obscene, or infringing on intellectual property rights.
• Attempts to gain unauthorized access to our systems or interfere with the service.
• Uses automated scripts or bots to access the service.
• Resells, redistributes, or reverse-engineers the service.

9. Intellectual Property

You retain all ownership rights to the photos you upload. We do not claim ownership of your content. You grant us a limited license to process your photos solely for the purpose of providing the retouching service.

Foyro's name, logo, software, and all related intellectual property are owned by Andrii Tsyhanok. You receive a limited, non-exclusive, non-transferable license to use the service subject to these Terms.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your unused tokens will be forfeited.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Foyro and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the tokens that gave rise to the claim.

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded or limited under applicable law, including mandatory consumer protection rights.

12. Disclaimer

The service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that retouched photos will meet your specific expectations. AI-generated results may vary.

13. Governing Law

These Terms are governed by the laws of Romania and the applicable laws of the European Union. Any disputes shall be resolved in the courts of Romania.

If you are a consumer resident in the EU, nothing in these Terms deprives you of the protection afforded by provisions that cannot be derogated from by agreement under the law of the EU member state in which you reside.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the service after changes constitutes acceptance of the revised Terms.
